Liability Disclaimer

Weeple, the Organisation, shall not be liable for any compensation related to damage or loss of any kind. To ensure the safety of goods, insurance is mandatory. Customers must arrange insurance for goods being transported.

Weeple acts as an aggregator, facilitating truck services for transporting goods. Neither Weeple nor any parties involved in the transportation process (including Transporter, Driver, Truck Owner, Mediator, Commission Agent, Broker, Godown/Warehouse Incharge, or Godown/Warehouse Owner) shall bear liability for any loss or damage under any circumstances.

The party booking the service (Sender, Receiver, or Billing Party), whether directly or indirectly, assumes full responsibility for any loss of goods.

Cancellation Charges

A cancellation fee of Rs 2,500 applies for full truck bookings and Rs 500 for part truck bookings, provided the goods have not yet been processed for transport. Any additional expenses incurred will be charged separately, in addition to the cancellation fee.

Government Assessments and Documentation Errors

If goods are reassessed by government authorities for state or central taxes/charges, any additional amount payable due to such reassessment shall be borne by the Consignor or Consignee. If a vehicle is detained by authorities due to errors in documents prepared by the Consignor or Consignee, an extra charge of Rs 200 per hour will apply.

The Consignor is solely responsible for all consequences arising from incorrect declarations regarding the quantity, quality, or nature of goods. The Consignor is also solely responsible for the transportation of controlled goods. The booking party is liable for any costs, expenses, or charges resulting from special instructions provided by them.

Payment Responsibilities

The party booking the service is fully responsible for settling any outstanding "to-pay" amount. Payment must be made within one hour of goods delivery. Failure to pay within this timeframe will incur an additional charge of Rs 200 per hour for every hour after the first hour.

Detention Charges

If goods are not loaded or unloaded within 4 hours of the vehicle’s arrival, a detention charge of Rs 200 per hour will apply. If the delay exceeds 6 hours, a charge of Rs 2,000 per day will apply, subject to a minimum of Rs 2,000.

Claims and Delivery

No claims will be accepted after the delivery of goods. Customers must inspect goods at the time of delivery.

For perishable goods, Weeple shall not be liable for compensation if the truck fails to reach the destination due to unforeseen circumstances.

The Consignor is solely responsible for any loss of goods due to inadequate packaging.

Declaration

Consignments are accepted on a "Said to Contain Basis." Weeple is not obligated to verify the description or contents of the consignment as declared by the Consignor on the Consignment Note, Invoice, Dispatch Note, Bill, or Challan.

The Customer warrants that the consignment does not contain prohibited items, including:

  • Currency, Liquids & Semi-liquids, Pornography, Bullion, Drugs and Narcotics (illegal), Firearms or parts thereof, Ammunition, Precious & Semi-Precious Items, Radioactive Material, or Commodities banned by law.
  • Consignments likely to cause damage or delay to equipment, personnel, or other consignments.
  • Consignments requiring a special license for transportation.

Documentation

The Consignor/Consignee must provide complete and accurate documentation, including the Shipper/Receiver’s name, addresses, telephone numbers, email IDs, invoices, and Stock Transfer Note (STN) as per statutory requirements. The Consignor/Consignee/Billing Party is responsible for preparing the E-way Bill where required. Failure to do so will make them liable for all related expenses, charges, fees, or fines, and they must compensate Weeple for any costs incurred before delivery. Goods will remain under a lien until all dues are cleared.

Weeple shall not be liable for deficiencies in documentation or statutory compliance, and no claims or grievances arising from such issues will be entertained.

Statutory Payments

The Billing Party is solely responsible for all government-imposed payments, fees, or taxes. If a consignment is held by statutory authorities (e.g., GST, customs, or tax officials), Weeple will not be responsible for any consequential loss or freight refund. The Consignor/Consignee/Billing Party must indemnify Weeple for any claims arising from insufficient documentation or incorrect declarations.

Liability Limits

For consignments declared as having No Commercial Value (NCV), Weeple’s liability is limited to Rs 100 only.

Weeple assumes no liability for goods that are outwardly intact at the time of delivery. Claims for damage, shortages, breakage, leakage, or pilferage will not be entertained after delivery.

For special consignments (e.g., ice cream, medicines, vaccines, photo films), the Consignor must notify Weeple in advance.

Payments

If the consignment note indicates "Paid," the Consignor must pay the freight at or before pickup. If marked "To Pay," the Consignee/Billing Party must pay the freight and other charges at the time of delivery. A charge of Rs 200 per hour will apply for delays in payment of the "to-pay" or "due" amount after the first hour, including any dues owed to Weeple (e.g., halting, fines, reimbursements).

Lien

Weeple retains a general lien over all consignments until all dues payable to Weeple are cleared.

Force Majeure

Weeple shall not be liable for loss or damage to consignments caused by acts of God, inherent defects in the goods, Consignor’s fault, fraud by the owner/Consignor, defective packaging, or actions by government officials (e.g., Customs, Taxation, Octroi inspections). Weeple is also not liable for losses due to events beyond its control, including strikes, riots, political disturbances, fire, vehicle accidents, explosions, extremist acts, looting, robbery, hijacking, bandh, floods, or other disruptions on highways or routes.

Indemnity

The Consignor/Consignee/Billing Party must compensate Weeple for any loss caused by their consignment to other goods in the vehicle due to incorrect declarations or inherent nature of the goods. They are also liable for losses due to seizure by government authorities resulting from improper or incomplete documentation, which may delay other consignments.

Packaging

The Consignor must provide goods properly packed in commercially saleable condition. Weeple is not liable for damages caused by improper or defective packaging.

Definition of Billing Party

The "Billing Party" refers to the party (Consignor, Consignee, or other) booking the transportation service and agreeing to pay the specified amount as per the invoice, subject to these terms and conditions and any additional terms communicated via email.
